Brandon Rittiman<p>The hearing has been postponed at least 1 week.</p><p>Judge Daniel Flynn has switched his position since the April 3 hearing.</p><p>Back then, he said he was inclined to allow the case to proceed on reckless arson and manslaughter charges.</p><p>Since then, he's said in a tentative ruling that he plans to grant PG&E's motion to dismiss those most serious charges. If so, the DA could appeal or re-file the charges.</p><p>Still, this appears to have prompted talks between the DA and PG&E-- which is why there's now a 1-week delay.</p><p>Last year, PG&E negotiated a civil settlement with DA's (including Shasta) that averted criminal charges for the 2019 <a href="https://sfba.social/tags/KincadeFire" class="mention hashtag" rel="tag">#<span>KincadeFire</span></a> and 2021 <a href="https://sfba.social/tags/DixieFire" class="mention hashtag" rel="tag">#<span>DixieFire</span></a>.</p><p>Will keep an eye on the <a href="https://sfba.social/tags/ZoggFire" class="mention hashtag" rel="tag">#<span>ZoggFire</span></a> case and update you when we know more.</p><p><a href="https://sfba.social/tags/PGEManslaughterHearing" class="mention hashtag" rel="tag">#<span>PGEManslaughterHearing</span></a></p>

PG&E insisted the tree had been inspected and was sound. Among McNeil's conclusions was that the base of the tree was seriously weakened from prior incidents, including a 2008 fire, and that "a cursory visual inspection of the base of the tree would almost certainly have revealed the extensive decay." <a href="https://sfba.social/tags/ZoggFire" class="mention hashtag" rel="tag">#<span>ZoggFire</span></a></p>
