#USIP’s building is privately owned by the institute & paid for through the institute’s endowment, 2 employees said, unlike its overseas programs & staff salaries, which are paid through federal funds appropriated by #Congress. “So to me this seems like the most egregious violation of the #law,” said one employee.

[Prior to this] A federal judge had condemned the process through which the #Trump admin seized control of USIP but declined a motion for a #TRO.

#USIP & members of its fired board filed a lawsuit, naming #DOGE & its reps, #Trump & members of his Cabinet. The suit claims the #ExecutiveBranch had no authority to dismiss the leadership & staff of the institute because it was created by the #LegislativeBranch [#Congress], nor could it take over USIP’s privately owned HQ building. Briefs in the case are scheduled during April, with a hearing near the end of the month.

Ya see now, in order for this BS to be true, the individuals would have needed to go through #DueProcess for the ofcls to make the determination:

“That order is forcing the United States to harbor individuals whom national-security officials have identified as members of a foreign terrorist organization bent upon grievously harming Americans.“

Woo hoo!!!!

🚨NEW: The US Court of Appeals for DC just DENIED #Trump's request to stay Judge #Boasberg's halt on the use of the #AlienEnemiesAct.

The decision is 2-1, w/ Trump appointee Judge Walker dissenting [shocker] on jurisdictional [technical, not merits] grounds, arguing the lawsuit should have been brought in Texas.

Just called my Rep and Senators to encourage them to pursue the group chatters as the law requires, shut down the Speaker’s suggestion we close the federal courts and stop the government from taking people without due process and sending them to foreign prisons.

Please call yours too. I used @5calls, and you can also find your people’s contact info here:

#Trump is now attempting to invoke #StateSecrets privilege [🚩] in the #AlienEnemiesAct case, claiming that due to “state secrets” (ignore the fact that trump live tweeted the entire affair) & therefore will give Judge #Boasberg no more information about #deportation flights to inform his decision about whether the gov't defied his orders

There is a #new court filing regarding the #AlienEnemiesAct, w/2 affidavits.

8 women were mistakenly sent to the #ElSalvador prison & had to be flown back.

Nicaraguan man (not Venezuelan) was also mistakenly sent to El Salvador prison & had to be flown back.

This is haphazard execution of a #law that never should have been invoked in the first place, since hello! we aren’t at war with anybody!

“Does the government agree that they’re entitled to notice that they are being removed based on their status as a member of Tren de Aragua under the president’s proclamation under the (#AEA) & an opportunity to challenge that before they are removed from the United States?” appeals court Judge Patricia Millett asked DOJ atty Drew Ensign.
