Gladwyn d’Souza<p>Elie Mystal- The Supreme Court must be made to pay a price—a political, institutional, professional price—for its ongoing political thuggery lightly disguised as jurisprudence. Its members will never stop acting like the only nine Americans who matter until we stop them from doing that. And the only way to stop them is to limit their power, their budgets, and their unearned belief in their own supremacy.</p><p>The problem is aided and abetted by the elected branches of government. Gladwyn d’Souza<p>But the Supreme Court justices seemed entirely averse to discussing the fundamental issue of what happened on January 6.<br />For most of the hearing, it was truly Hamlet without the prince, with endless hairsplitting over legal technicalities, and no discussion of the January 6 insurrection and the wider threat to American democracy.<br />In one exchange with Justice Brett Kavanaugh, Mitchell conceded that Trump is&amp;nbsp;arguing that a state has no power to penalize him for the January 6 insurrection, that the only remedy is federal prosecution, but at the same time he is arguing, in a separate case now also headed for the Supreme Court, that as a former president he is immune from federal prosecution.
